sharad pawar vs gopinath munde

 

 

 

   

Nationalist Congress Party (NCP) chief Sharad Pawar has approached the civil court pleading that a suit filed against him be transferred from the present court to any other civil court as it is “necessary for a fair trial”.


The application (dna has a copy) says BJP leader Gopinath Munde had filed a civil suit in a court presided over by judge MS Sharma, challenging Pawar’s appointment as Mumbai Cricket Association (MCA) president.          


According to Munde, MCA allegedly helped Pawar become president by maliciously adjusting election days. Munde claimed he had also applied for the post but MCA allegedly maliciously rejected his application as his electoral card did not show his address as Mumbai, and that Munde did not fulfil criteria.


Meanwhile, Munde filed an interim plea in the same court, pleading that it restrain Pawar from discharging his duties as MCA president. The court held that it did appear that rules were violated by MCA and it imposed a stay on Pawar’s functioning. However, when Pawar’s lawyers challenged this order in Bombay High Court, the latter turned down the civil court’s order.


Pawar’s plea reads: “As the sessions court has already referred MCA’s provision while deciding on Munde’s application... we plead the principal court to transfer the matter from the current court to some other civil court.”


Munde’s advocate Vivekanand Gupta told dna: “All I can say is that Pawar’s application shows his lack of faith in the judiciary.”
